Unfortunately, the issue we had hoped was isolated to 101 Mahan has now become more apparent and prevalent this year. This time, it involves a house at 766 Lake Shore Terrace and its accompanying septic system, both of which were constructed without any permits. Even the well that was drilled on the property during the week of 10/14/2024 was done so without the necessary permit. Furthermore, the shed on the premises is in violation of County Codes and the Governing Documents due to the failure to obtain a zoning permit, which would have prevented this violation. This is just one example among many in this subdivision where the required permits were not obtained.
It's important to note that the responsibility for obtaining permits lies with the property owner, not the contractors. In addition to the permit violations, the house also fails to comply with the Governing Documents. Surprisingly, we were told that the plans were approved by the directors themselves. We hope the owners got that in writing. This is from President Weavers “2024 bylaws”; If no plans are submitted for approval before the work is started, a fine can be imposed. This is another indication that not only are the directors and officers disregarding the law, but they also allow certain members to do the same.
Considering the extent of code and CC&R violations in this subdivision, we are considering posting a map or list of properties where permits were not obtained for work done. Prospective buyers should be cautious and thoroughly examine areas that have skipped county inspections. While we were traveling around the sub-division, we discovered yet another reason why the board fails to enforce the governing documents or County Code: President Weaver's son's property is also in violation of codes and the governing documents. The directors wouldn’t recognize a fiduciary duty if they tripped over one.

The original deadline for the agreement for improvements to be made at the Santiago’s residence expired December 31st. The Board voted to grant a deadline extension to June 30, 2008 as previously requested by the Santiago’s. If the pump house, larger front deck and yard sodding are not completed by the new deadline, fines will be recommended.
The bylaws were enforced back then and so much more.
